The Federal High Court sitting in Abuja has struck out the application by the Department of State Services, DSS, to further detain the publisher of SaharaReporters and convener of RevolutionNow, Omoyele Sowore.
Justice Taiwo Taiwo gave the order following the withdrawal of the application by the state counsel on Tuesday.
Counsel to Sowore’s, Femi Falana, prayed the court to order immediate release of his client as the prosecution was no longer interested to detain him further.
Counsel to the DSS, however, challenged the oral application for release saying that a formal suit has been filed against Sowore for alleged treasonable felony which is a capital offence.
Recall that Sowore was arrested on August 3, for calling a national protest tagged Revolutionnow
He was accused of plotting to overthrow an elected government.
The prosecutor therefore asked the Court to deny the him bail due to the fresh charges filed against him.
In his ruling, the judge said the activist should be released to his lawyer, Mr. Femi Falana (SAN), who is to produce him for arraignment whenever he is required.
The Judge also said since charges had already been filed against the activist, he must deposit his passport and other travel documents to guarantee his availability for trial
