Breaking: APC elite group sues Tinubu, APC leadership, seeks to bar Lagos APC from National Convention

New Lagos Movement, an elite group within the All Progressives Congress (APC), has filed an action for an injunction to present the current executive of the Lagos APC from participating at the forthcoming National Convention of the party.

The suit was filed this afternoon at the Federal High Court, Lagos, by Akinniyi Akinsiju, Michael Popoola Ajayi, Olugbenga Fakoya, Toyin Raheem and Taiwo Sanyaolu.

Joined as defendants in the Suit No: FHC/L/CS/669/14 are Asiwaju Bola Ahmed Tinubu, Dr. Garbaabari, Chief Bisi Akande, APC and the Independent National Electoral Commission (INEC).

In the suit filed on their behalf by their counsel, Nurudeen Ogbara, the plaintiffs, all registered members of APC Lagos and participants in the party’s congresses held between April 5 and 26, 2014, allege that “rather than allowing the electoral results of the congresses to be held, the 1st Defendant (Tinubu) went ahead to be substituting losers with winners thereby putting in party offices his stooges.”

They also accuse APC of having “unilaterally zoned the 2015 governorship ticket of Lagos State to Lagos East comprising of Epe and Ikorodu areas of Lagos State.”

“It is the position of the Plaintiffs that these acts of the 1st Defendant are contrary to the Constitution of the 4th Defendant and in breach of the Constitution of the Federal Republic of Nigeria,” according to court papers in the possession of News Express.

The plaintiffs are seeking the following:

“An order of interlocutory injunction restraining the 1st, 2nd and the 4th Defendants whether by themselves, agents, privies, or whomsoever from presenting or recognizing any delegate as may be presented by the Lagos Chapter of the 4th Defendant at the National Convention of the 4th Defendant scheduled to hold on the 13th and 14th days of June 2014 or at any other time when so ever pending the final determination of this suit.

“An order of interlocutory injunction restraining the Defendants whether by themselves, agents, privies, or whomsoever from allowing any delegate as may be presented by the Lagos Chapter of the 4th Defendant to participate at the National Convention of the 4th Defendant scheduled to hold on the 13th and 14th days of June 2014 or at any other time pending the final determination of this suit.”
