Federal High Court in Ado Ekiti, today, dismissed the suit filed by the Senator Biodun Olujimi’s group, against the People’s Democratic Party (PDP) Ward Congresses conducted in March 7, 2020.
Delivering judgment on the suit number FHC/AD/CS/14/2020, the court awarded N200,000 cost against the plaintiff and their Counsel to be paid to the PDP, the 4th and 5th defendants on or before of September 1, 2020.
Olujimi, had through one Oladimeji Samson Olalekan sued the PDP, Independent National Electoral Commission (INEC), Inspector General of Police (IGP) and others, seeking nullification of the March 7, 2020 Ward Congress, which was won by loyalists of former Governor Ayodele Fayose.
In its judgement today, the Court said that looking at the amphibious features of this case as instituted by the Plaintiff, this case is undoubtedly not justiceable as same within an internal affairs of the PDP.
Justice Uche N. Agomoh held that the Plaintiff’s case was undoubtedly not justiceable “as same is within an internal affairs of the PDP,” citing UKUT vs. APC.
The judge ruled that the Court lacked the requisite jurisdiction to entertain the Plaintiff’s suit and subsequently dismissed it.
Justice Agomoh also held that Counsel were in the best position to advise their client in the best practice.
