Former Deputy Chairman of The All Progressives Congress (APC) Chief Segun Oni’s appeal against Ekiti State Governor, Dr Kayode Fayemi has been dismissed by the Appeal Court.
The Appeal court in its ruling in Ado Ekiti, the State Capital on Tuesday affirmed that Fayemi complied with relevant provisions of the law guiding public servants on resignation before contesting election.
“As Minister of FMMSD, Fayemi needed not to resign in order to contest the primary of the party. He is only compelled to resign 30 days to the election which he did.”
On White Paper, the Appeal court ruled that nothing in the White Paper shows that Fayemi was prosecuted or convicted.
The court Also ruled that the Commission of enquiry is not a court of competent jurisdiction.
“It can only recommend a person for trial. It cannot try a person neither can it convict a person.”
